Spanish law is clear and strict about off-plan property. The sellers have to put any funds they receive into escrow and can only access it once that have reached agreed stages of the build.

There are also strict rules about the guarantees that off-plan sellers must offer their buyers. These include a 10-year structural guarantee.

If you buy an off-plan property, it’s well worth getting a lawyer, asesor or estate agent to check your contract to make sure that it complies with the law.

Buying off-plan can save you a significant amount of money and allows you to stagger payments so you don’t have to spend all your capital at once. However, new build property does tend to sell at a premium of 10-20% of the equivalent second-hand property.
